$Confidential Sexual Assault – Recovery for a hotel guest who was sexually assaulted while she was sleeping in a hotel room. The assailant was served alcohol at the hotel and was kicked out of the bar. Rather than escort him to his room, they pointed him in the room’s direction. He broke into our client’s room, stole money and then attempted to sexually assault her. A background check revealed that the assailant was on probation in his home state for alcohol-related offenses.
$Confidential Sexual Assault – Recovery for a customer at a Used Car Dealership who was sexually assaulted by the car salesman as he drove her around to test drive a vehicle. The police declined to press charges after the salesman denied the claims. Through discovery, we located another customer who was victimized by the same salesman the year prior and filed a police report against him. The dealership knew about the prior allegation but did nothing to protect the public.
$Confidential Sexual Assault – Recovery for a customer at a major fast food chain who was sexually assaulted by the store’s manager in the store bathroom. The customer asked the manager for the bathroom key since it appeared the bathroom was closed. The manager escorted her to the bathroom then followed her in, where he then attempted to fondle her and kiss her. She was able to escape and the manager was charged with criminal battery. We won the case against the restaurant.
$Confidential Molestation – Recovery for a young girl who was molested by a Church pastor at an overnight event. The church tried to buy off our clients to get them to fire their attorneys if they “forgave them” for the wrongs of the pastor.
$Confidential Molestation – Recovery for an 8 year old severely autistic girl who was molested by a janitor at a private special needs school. The State Attorney’s Office lost the case at trial because the young girl could not talk about what happened to her. We let the evidence speak for her and won the civil case. Through another teacher and 911 tapes, we were able to show how calls were immediately placed to the police stating that the janitor was found in a closet with the young child. Our investigation also revealed a history of complaints made to the school and DCF about the janitor by other child victims.
$Confidential Molestation – Settlement for a 2 ½ year old boy who was sexually assaulted by a teacher’s aide during nap time.
$Confidential Shooting – Recovery for a high school boy in northern Florida who was shot in the eye with a BB Gun.
$Confidential Assault and Battery – Recovery for a Tampa man who fractured his skull and required surgery when he was pushed down the steps of a busy bar.
$250,000.00 Molestation – When the family of a 7 year old girl moved into their trailer park, they paid a background check fee. A few months later, their daughter was molested by a neighbor. Our thorough investigation revealed the presence of several convicted sex offenders living in the community. We also conducted a background check on the molester and found that he was charged with molesting his own child prior to our client’s incident. The trailer park denied liability and alleged that they had no notice of the neighbor’s background. The child will receive payments to help with counseling for the rest of her life as part of the settlement.
$100,000.00 Molestation – Policy limits were recovered on behalf of a young girl who was molested by her father. Insurance generally excludes immediate family members from coverage. We were able to get around this argument after finding that the grandparent knew about the repeated molestations and continued to allow the father to molest the daughter after she was removed from the home.
$100,000.00 Molestation – Policy limits were recovered for a girl who was molested by her friend’s dad over a 2 year period. Our investigation revealed a significant criminal record on the molester which the molester’s family hid from our client.
