Consumer Product Liability Claims We Handle

Our primary focus is protecting everyday consumers from hazardous household items. We can investigate design defects, manufacturing errors, and “failure to warn” claims for a massive variety of products. Below are some of the most common consumer product lawsuits we can handle across Florida and nationwide.

Exploding Pressure Cookers

Florida Product Liability Lawyers

Electric pressure cookers are marketed with “foolproof” safety features, yet we have seen hundreds of cases where these features fail. When a lid unlocks while the pot is still pressurized, the boiling contents erupt, causing severe second and third-degree scald burns. Our pressure cooker injury lawyers regularly sue major brands like Instant Pot, Crock-Pot, and Tristar.

Coffee Pot Explosions

Glass carafes and pressurized espresso machines can shatter or explode without warning. Micro-fractures in the glass, combined with sudden temperature changes or a defective heating element, can send boiling coffee and glass shrapnel flying into a user’s face and eyes, causing severe lacerations and thermal burns.

K-Cup Explosions

Single-serve coffee makers force pressurized hot water through a tiny plastic pod. If the puncture needle is defective or the machine over-pressurizes, the K-Cup can burst. This can shoot a high-velocity stream of boiling water and coffee grounds directly back at the user, resulting in severe facial burns and permanent scarring.

Defective Ladders

A fall from a ladder can cause spinal cord damage, traumatic brain injuries, and shattered limbs. We handle claims involving aluminum and fiberglass ladders that buckle, locking hinges that unexpectedly release, and feet that fail to provide promised slip resistance. Manufacturers should be held liable when their weight-bearing products fail under normal use.

Chairs That Collapse

Whether it is an office chair, a patio lounger, or a barstool, a sudden structural collapse can result in devastating tailbone injuries, herniated discs, and head trauma. These failures are often traced back to weak welds, defective pneumatic cylinders, or cheap plastic components that degrade quickly under regular load.

Step Stools That Break

Folding step stools are common in kitchens and closets. However, if the plastic locking mechanisms are brittle or the metal pins shear off, the stool can instantly fold in on itself while bearing weight, leading to severe ankle fractures, wrist breaks, and knee injuries.

Toys That Break

Children are the most vulnerable consumers. Toys with defective battery compartments, easily detached small parts (choking hazards), or toxic lead paint frequently trigger massive CPSC recalls. We can fight aggressively for families whose children have been injured by negligent toy manufacturers who prioritize cheap production over safety.

Grill Brush with Bristles That Come Off in Food

This is a terrifying and increasingly common injury. Cheaply manufactured wire grill brushes can shed steel bristles onto the grill grates. These bristles stick to food, are swallowed, and become lodged in the victim’s throat or intestines. This often requires emergency exploratory surgery to remove the metal wire and repair punctured organs.

Starbucks Coffee Cup Failures

Drive-thru and takeout coffee cups must be designed to safely hold scalding liquids. When a lid is defectively designed, pops off unexpectedly, or a paper cup collapses due to weakened adhesive seams, the result can be second and third-degree burns to the lap, groin, and thighs.

Ryobi Power Tools

Power tools inherently carry risk, but they must have functioning safety guards and reliable triggers. We can investigate claims involving Ryobi and other power tool brands where safety guards fail to deploy, saws bind and kick back due to design flaws, or lithium-ion batteries overheat and ignite during use or charging.

Defective Helmets and Safety Pads

When you buy a motorcycle, bicycle, or sports helmet, you are generally buying a promise of safety. If the internal EPS foam is substandard, or the chin strap rivets fail upon impact, the helmet cannot prevent traumatic brain injury. We can fight to try and hold safety equipment manufacturers strictly liable when their products fail to perform in an emergency.

E-Bikes

Electric bikes are surging in popularity, but cheap lithium-ion batteries and faulty motor controllers are causing catastrophic accidents. E-bikes have been known to suddenly accelerate without throttle input, lose braking power due to electrical faults, or burst into flames while charging in a garage or apartment.

Power Bank Fires

Portable USB power banks are filled with densely packed lithium-ion cells. If the internal battery management system (BMS) lacks overcharge protection, the device can experience “thermal runaway.” This can cause the power bank to explode in a user’s pocket, purse, or backpack, causing severe chemical and thermal burns.

Massage Gun Fires

Percussive massage guns require high-capacity batteries to operate their powerful motors. We have seen claims where defective charging cables or internal battery flaws cause the device to overheat, melt its plastic casing, and start a house fire while left unattended on a charger.

Battery Fires

Beyond e-bikes and massage guns, defective lithium-ion batteries in laptops, vapes, hoverboards, and smartphones can be highly volatile. When these batteries rupture, they release toxic gases and intense flames that are incredibly difficult to extinguish, often resulting in devastating property damage and bodily injury.

Electric Steamer Splash Burns

Facial steamers and handheld clothing steamers boil water to produce vapor. If the nozzle is poorly designed or the internal pressure valve fails, the device can spit large droplets of boiling water directly into the user’s face, neck, or eyes, causing severe localized burns.

Defective Oven Burns

Gas and electric ovens can suffer from defective thermostats or faulty door hinges. We can handle claims where ovens fail to regulate temperature, causing sudden grease fires, or where heavy oven doors unexpectedly spring shut on a consumer’s arms while retrieving hot food.

Defective Fireworks Burn and Amputation Injuries

Even when used strictly according to the instructions, defectively manufactured fireworks can explode instantly upon lighting (short fuses) or fire laterally into a crowd rather than straight up into the air. These manufacturing defects can result in lost fingers, severe facial burns, and catastrophic eye injuries.

Defective Scooters and Onewheels

Electric scooters and self-balancing skateboards (like the Onewheel) rely on complex gyroscopes and proprietary software. If the software abruptly shuts down the motor while the user is traveling at 15+ mph, the device can “nose-dive,” violently throwing the rider onto the pavement and causing shattered collarbones and traumatic brain injuries.

Electrocution Injuries and Wrongful Death

Any appliance with frayed internal wiring, poor insulation, or missing ground wires can be a lethal threat. Defective hair dryers, pool pumps, and power tools can deliver fatal electrical shocks. In these tragic cases, our Florida wrongful death attorneys can fight to secure justice for the surviving family members.

Heated Clothing Burns and Defects

heated insole fire burn injury claim help

As winter recreation gear becomes more advanced, the integration of lithium-ion batteries and heating coils directly into fabric has created a new wave of severe product liability injuries. When the internal thermostats fail, these garments can reach temperatures capable of melting synthetic fabrics directly into the wearer’s skin.

Heated Insoles

Insoles can heat to a very high temperature, leading to serious burns if the product fails.

Heated Socks

Defective heated socks can short-circuit when exposed to normal foot sweat or snow moisture. Because they are worn tightly against the skin inside heavy boots, the wearer often cannot remove the sock fast enough when the coils overheat, leading to deep third-degree burns on the feet, toes, and ankles.

Heated Jackets

Battery packs stored in the pockets of heated jackets are prone to thermal runaway. A defective jacket can suddenly catch fire, engulfing the wearer in flames. Furthermore, broken internal wires can create localized “hot spots” that severely burn the wearer’s chest or back without warning.

Heated Boots

Ski boots and work boots with built-in electronic heaters are subjected to heavy impacts. If the battery casing is poorly designed, physical trauma to the boot can puncture the battery cells, causing the boot to spontaneously combust while securely fastened to the victim’s foot.

Heated Gloves

Heated motorcycle and ski gloves rely on micro-wires woven through the fingers. Over-flexing can cause these wires to snap and arc, shocking the wearer or causing the glove to ignite, resulting in severe thermal burns and permanent nerve damage to the hands.

Automotive Product Liability

Automobile manufacturers have vast resources and teams of defense lawyers. When a car accident is caused or made significantly worse by a vehicle defect, you may need a law firm capable of taking on the automotive industry. We can handle complex motor vehicle crash cases involving:

Tire Tread Separation

When a tire is manufactured with old rubber, poor adhesives, or in contaminated facilities, the tread can literally peel off the tire body at highway speeds. This usually results in a catastrophic blowout and vehicle rollover. Often, body shops may retread tires and sell them as safer, cheaper alternatives to new tires, but these can fail. We can sue major tire manufacturers and body shops when their products fail prematurely and cause severe injuries.

Airbag Shrapnel Explosion Injuries

The Takata airbag recall highlighted a deadly defect: moisture penetrating the airbag inflator. Upon deployment, the metal inflator housing shatters, shooting metal shrapnel directly into the driver’s face and neck at over 200 mph. These injuries closely resemble gunshot wounds and could be fatal.

Inadvertent Spontaneous Airbag Deployment

Airbags are meant to save lives during a crash. However, defective impact sensors or faulty wiring harnesses can cause an airbag to deploy violently while you are simply driving down a smooth road. This explosion can break arms, cause facial fractures and serious burns, and force the driver to lose control of the vehicle.

Accidental Vehicle Shutoff

Defective ignition switches (like those seen in the massive GM recall) can be easily bumped by a driver’s knee or weighed down by a heavy keychain. The vehicle can instantly shut off while driving at highway speeds, disabling the power steering, power brakes, and preventing the airbags from deploying in the resulting crash.

Vehicle Rollback Injuries

When a transmission has a defective “Park” detent or an electronic gear selector provides false feedback, a driver may logically believe their vehicle is in park when it is actually in neutral or reverse. The vehicle can then roll backward, crushing the driver as they attempt to exit or injuring pedestrians behind the car.

Autonomous Vehicle Crashes

Self-driving technology (like Tesla Autopilot or Full Self-Driving) relies on cameras, radar, and complex AI. When the software fails to recognize a stopped emergency vehicle, a pedestrian, or a crossing tractor-trailer, the resulting high-speed impact could be a direct result of software and design defects.

Seatback Failures

In a rear-end collision, a properly designed seat should remain upright to protect the occupant. Defective seat recliner mechanisms can snap upon impact, causing the front seat to collapse violently backward. This could launch the front passenger into the rear seat, causing catastrophic injuries to children sitting in the back or breaking the driver’s back or neck, or causing other serious injury.

Pharmaceutical Product Liability

When “Big Pharma” rushes a drug to market without adequate clinical trials, or actively hides known side effects to boost profits, the public pays the price. We can handle dangerous drug lawsuits involving medications that cause unexpected heart attacks, internal bleeding, kidney failure, stroke, death, or birth defects. Under Florida’s strict liability laws, drug manufacturers can be held liable for “failure to warn” consumers and doctors about the true, deadly risks of their medications.

Medical Device Lawsuits

Millions of Americans rely on implanted medical devices to improve their quality of life. Unfortunately, defective metal-on-metal hip replacements, faulty pacemakers, surgical mesh, and defective IVC filters often fail prematurely. When a medical device breaks or degrades inside the body, it necessitates painful, high-risk revision surgeries. Our firm can fight to hold medical device manufacturers accountable for defective designs and inadequate safety testing.

Understanding Florida Product Liability Law

Product liability in Florida is governed by the doctrine of Strict Liability. This is a massive advantage for consumers. It means you do not have to prove that the manufacturer was explicitly “negligent” or careless. You only need to prove that the product contained a defect that made it unreasonably dangerous, you used the product as intended (or in a reasonably foreseeable way), and the defect directly caused your injury.

However, you must be aware of two critical deadlines:

  • The 2-Year Statute of Limitations: Due to the 2023 tort reform (HB 837), you now have only two years from the date of the injury to file a product liability lawsuit in Florida.
  • The 12-Year Statute of Repose: Florida law completely bars any product liability lawsuit if the injury occurs more than 12 years after the product was first sold to its original purchaser. Even if a 15-year-old product explodes and causes severe injuries, the manufacturer could be legally immune.

Note that there could be defenses though to pause the statute of limitation and statute of repose where the manufacturer fraudulently concealed the defect, among other possible arguments.

Florida Product Liability FAQs

What should I do with the defective product that injured me?

Do absolutely nothing to it. DO NOT throw it away, DO NOT try to fix it, and DO NOT return it to the manufacturer or the store for a refund. The product can be the single most important piece of evidence in your case. Store it safely exactly as it is and contact our firm immediately so our engineers can inspect it or otherwise give you guidance on preserving the product.

Can I sue Amazon or Walmart if I bought the defective product there and got hurt?

Yes. Under Florida’s strict liability laws, any entity in the ‘chain of distribution’ including the retailer who sold it, the distributor who shipped it, and the manufacturer who built it can be held legally responsible for placing a dangerous product into the hands of a consumer.

Can I file a product injury lawsuit if the manufacturer is based overseas in China?

We handle this issue regularly. We can pursue the foreign manufacturer through international legal channels, but we can also hold the American distributors, importers, and retailers (like Target, Amazon, or Best Buy) strictly liable right here in U.S. courts, fighting to help ensure you have a viable source for financial recovery.

Is there a recall for the product that hurt me?

There may be, but a recall is NOT required to file a lawsuit. In fact, our lawsuits can uncover the defects that can lead to the Consumer Product Safety Commission (CPSC) to issue a nationwide recall later. If a product hurt you because it was unreasonably dangerous, you could have a case regardless of whether a recall has been issued.
