We are often asked what the difference is between pursing a criminal case and a civil case. In the criminal case, the State Attorney generally focuses on the criminal. The goal seems to be punishing the criminal for committing a crime against the State of Florida. This is why the case is titled State of Florida vs. Defendant X. The victim is often seen as a witness to the crime committed against the State of Florida.
In the civil case, we focus on the crime itself. Could the crime have been prevented? Was the crime foreseeable? If it was preventable and/or foreseeable, did someone or some company fail to adequately prevent the crime? We also pursue the case on behalf of the victim or their family directly. Part of our job is to get the victim and their families answers as to why this happened and how it can be prevented in the future.
