Types of Florida GM Recall Claims

If you or a loved one had an accident in a recalled GM vehicle, you may be entitled to compensation. We are currently investigating cases where any of the following occurred:

  • Vehicle ignition turned off or moved positions causing vehicle to lose power
  • Airbag failed to deploy
  • Airbag shot metal fragments at vehicle occupants

History of the GM Ignition Switch Recall

According to a Consent Order from 2014 filed by NHTSA, on February 7, 2014, GM notified NHTSA that it determined that a defect, which relates to motor vehicle safety, exists in 619,122 model year (“MY”) 2005-2007 Chevrolet Cobalt and MY 2007 Pontiac G5 vehicles. According to GM’s Part 573 Report, the safety- related defect concerns a condition in which the vehicle’s ignition switch may unintentionally move from the “run” position to the “accessory” or “off” position resulting in a loss of power.

GM indicated that this risk may be increased if the key ring is carrying added weight or the vehicle goes off road or experiences some other impact related event. GM also indicated that in some cases, the timing of the ignition switch movement relative to the activation of the sensing algorithm of the crash event may result in the airbags not deploying.

Damages You Can Recover If Injured From A Faulty Key Switch

The types of damages, or money, you can recover depends on several factors which we can go over with you. If you were injured because of a defective part in a GM car, you may be entitled to money for your property damage, pain and suffering, medical expenses, lost wages, out of pocket expenses and more.

If a family member was killed in a GM vehicle because of a defect, each survivor may be entitled to emotional pain and suffering, loss of support and services, funeral expenses for whoever paid them, and more. The Estate of the victim may be entitled to recover net accumulations, medical bills associated with treatment related to the car accident, and other possible damages. Each state is different and defines who is entitled to recover money for the crash, and what types of claims for money each person may have.

If someone is killed in Florida because of a faulty GM ignition switch, Florida’s Wrongful Death Act dictates who is entitled to different damages. Florida’s Probate Code also dictates who is entitled to be the Personal Representative to bring the claim on behalf of all of those entitled to make the claim. Under the Florida Probate Act, we generally look first to see if the person killed because of a GM car defect had a will. If so, this is called testate. We look at the will to see who was selected to be the Personal Representative to act on behalf of the Estate and all survivors. If the person killed because of a faulty part did not have a will, they died intestate. Florida law has rules to follow to appoint a Personal Representative. Our product liability attorneys have a probate department in our office who can help process the case as smoothly as possible.

What if I Was in a Car accident several years ago. Can I Still Bring a Claim?

Depending on the state you live in, you may still be able to bring a claim for personal injury or wrongful death even if the accident occurred several years ago. We are currently considering cases that occurred anytime from 2010 through the present where there was a personal injury or death.

It is helpful if you have any photographs of the vehicle or your injuries. We can help gather any medical records or bills from the doctors or hospitals where you got medical treatment. If a family member died, we can review the death certificate, traffic homicide report and other photographs and records to see if a defect in the vehicle caused or contributed to the crash.

What if the Victim was Injured by the Airbag?

In addition to claims against GM for faulty ignition switches, some vehicles may also have defective airbags which could deploy with so much force that pieces of metal shoot out and can injure or kill the driver or passengers. Some of these airbags can also deploy with more force than they are designed to and can cause much more serious injuries. When the ignition switch defect is present, the airbag system may even shut off, causing the airbags to fail to deploy in a crash.
