Your keys probably consist of more than just your car keys and house keys. You probably also have a work key, possibly a mailbox key, and like many people, an abundance of decorative key chains. You would never expect your keys to break the ignition and turn the car off while you’re driving it. In certain Nissan models, this is exactly what can happen. Know that it is not your fault, and that the manufacturer should be held liable if you are injured as a result of this defect.

The Ignition in your Nissan May Turn Off

In October 2018, Nissan North America, Inc. issued a recall that notified the National Highway Traffic Safety Administration (NHTSA) of a defective key ignition system in certain 2017 & 2018 Nissan models.

Certain Nissan vehicles were built with a mechanical key ignition system that are equipped with ball springs, which are susceptible to long term excessive wear and fatigue breakage. Over time, the weight of the keychain coupled with road conditions or some kind of sudden event can cause the ignition to suddenly switch from the on position to the “accessory” position. If this happens when the car is in motion, the engine could unexpectedly stop running, which may result in serious injury to occupants.

The vehicles that have been subject to the recall include:

  • Chevrolet City Express 2017
  • Nissan Frontier 2017-2018
  • Nissan NV1500 2017
  • Nissan NV200 2017
  • Nissan NV200 Taxi 2017
  • Nissan NV2500 2017
  • Nissan NV3500 2017
  • Nissan Sentra 2017
  • Nissan Versa 2017-2018
  • Nissan Versa Note 2017-2018

Nissan may be Liable for your Injuries

The mechanical key ignition built by Nissan for select models contains a possible design defect because there is a flaw in the way the ball springs were designed.

The manufacturer of defective auto parts may be held liable if the design defect causes a foreseeable risk of injury and that the product is being utilized for its intended purpose. Here, the keys are being used to start the engine so that the car will operate.

To prove that the product’s design was defective, the plaintiff may show:

  • The product was designed as intended
  • The design made the product dangerous to use as intended
  • There were safer alternatives than the design used
  • The cost of the safer alternative did not outweigh the risk of harm
  • The safer alternative would have made the product functionally the same and
  • There was an actual injury or loss suffered as a result of the design defect
